Effective Date: 12/01/2024 Company: Fiesta Hosting Solutions (“Fiesta Hosting,” “we,” “us,” or “our”)

By engaging Fiesta Hosting Solutions for Domain Registration, Web Hosting, SEO, or Design/Development services, you (the "Client") agree to be bound by the following terms and conditions.

1. General Service Agreement

Fiesta Hosting Solutions provides a multi-disciplinary suite of digital tools. All services are provided on an "as is" basis. While we pride ourselves on high-performance infrastructure and creative excellence, we do not warrant that services will be entirely uninterrupted or error-free.

2. Hosting & Domain Management

Service Availability: We strive for a [e.g., 99.9%] uptime. Fiesta Hosting is not liable for any loss of revenue or data resulting from service interruptions, hardware failures, or scheduled maintenance.

Domain Responsibility: While we facilitate registration, the Client is the legal owner of the domain. It is the Client’s sole responsibility to maintain valid payment methods for renewals. Fiesta Hosting is not responsible for the loss of a domain due to expiration or third-party registrar issues.

Data Backups: While we perform routine server-side backups, the Client is responsible for maintaining independent, off-site copies of their website files and databases.

3. SEO (Search Engine Optimization) Policy

Performance Variables: SEO is subject to the proprietary algorithms of third parties (such as Google and Bing). Fiesta Hosting Solutions cannot and does not guarantee specific search engine rankings, traffic increases, or a "Number 1" position.

External Factors: We are not responsible for ranking fluctuations caused by search engine core updates, competitor activity, or "Black Hat" techniques previously employed by the Client.

4. Design & Development Services

Scope of Work: Projects are completed based on the agreed-upon Statement of Work (SOW). Changes requested outside the original scope may result in additional billing.

Intellectual Property: Upon final payment, ownership of the website design and custom code is transferred to the Client. Fiesta Hosting retains the right to display the work in our portfolio unless otherwise agreed.

Third-Party Tools: We often utilize third-party plugins, themes, or APIs. Fiesta Hosting is not liable for disruptions caused by updates or vulnerabilities in these third-party products.

5. Acceptable Use & Security

The Client agrees to use Fiesta Hosting services for lawful purposes only. Prohibited content includes:

Unlicensed copyrighted material.

Malware, phishing scripts, or spam-generating software.

Content that promotes illegal activities.

Note: We reserve the right to suspend any account that poses a security risk to our network or other clients.

6. Limitation of Liability

In no event shall Fiesta Hosting Solutions, its directors, or employees be liable for any direct, indirect, or consequential damages (including loss of data or profit) arising from the use of our services, even if we have been advised of the possibility of such damages.
